Fibidy's commitment to copyright.
Fibidy respects third-party intellectual property rights and is committed to firmly acting on copyright infringement on the Platform.
Sellers are fully responsible for ensuring that products they upload do not infringe others' copyrights. Violations may result in product takedowns, account suspension, and permanent termination depending on severity.
This policy provides a mechanism for copyright holders to report infringements and for accused Sellers to file counter-notices.
How to report copyright infringement.
Copyright holders or their authorized representatives may report infringement by sending an email to admin@fibidy.com with the subject "DMCA Takedown" or "Copyright Report".
The report must include the following information:
Identification of the allegedly infringed work — title, description, and proof of ownership (copyright certificate, link to original publication, or other relevant documentation).
Identification of the allegedly infringing content on Fibidy — URL of the product page, product name, or product ID if known.
Reporter contact information — full name, address, email, and phone number.
A good-faith statement that the use of the reported content is not authorized by the rights holder, its agent, or the law.
A statement that the information in the report is accurate and that the reporter is authorized to act on behalf of the copyright holder.
Physical or electronic signature of the reporter.
Report review timeline.
Reports are reviewed within a reasonable time, typically within 7 business days of receipt.
If the report is complete and meets the criteria, Fibidy will perform a temporary takedown — the product is hidden from the public and downloads are blocked — pending response from the accused Seller.
The reporter and Seller will be notified of the status of the action via email.
Takedown process.
After a report is considered valid on its face, Fibidy hides the accused product and notifies the relevant Seller.
Products already purchased by Buyers before the takedown remain accessible to those Buyers unless specifically requested by the copyright holder to be blocked entirely (for example due to clear and serious copyright infringement).
The accused Seller has the opportunity to file a counter-notice within 14 days.
Counter-notice from the Seller.
A Seller who believes the takedown was mistaken or who has a legitimate right to the work may file a counter-notice via email to admin@fibidy.com with the subject "Counter-Notice".
The counter-notice must include:
Identification of the taken-down content and its location before the takedown.
A statement under oath that the Seller believes in good faith that the takedown was due to a mistake or misidentification.
Proof of rights to the work — copyright certificate, official license, assignment agreement, or other relevant documentation.
Full Seller contact information.
If the counter-notice is considered valid, Fibidy may reinstate the content. If the original reporter does not respond with additional evidence or legal action within a reasonable time, the content is restored.
False reports.
Filing false or misleading copyright reports is a serious violation that may result in legal consequences.
Reporters state under oath that the information provided is accurate. Fibidy may report false reports to the relevant authorities and block the reporter's account from filing further reports.
Repeat infringer policy.
Sellers who repeatedly upload content that infringes copyright will be subject to permanent account termination.
The specific number of violations that triggers termination is determined on a case-by-case basis based on severity, intent, and pattern of behavior. Generally, 3 validated violations are considered repeat infringement.
Terminated accounts cannot be reopened, and pending funds may be held under Stripe's policies.
Fair use and exceptions.
Fibidy recognizes copyright exceptions such as fair use, legitimate quotation for educational or critical purposes, public-domain works, and works under open licenses (Creative Commons, MIT, and so on).
Sellers relying on these exceptions must be prepared to demonstrate the legal basis for their use if accused of infringement.
Fibidy does not provide legal advice. Sellers are encouraged to consult a legal professional for complex cases.
Jurisdiction and applicable law.
This policy is governed by the laws of the Republic of Indonesia, including Law No. 28 of 2014 on Copyright.
The takedown mechanism in this policy adopts the spirit of the Digital Millennium Copyright Act (DMCA) as global best practice, adapted to the Indonesian legal context.
Copyright disputes that are not resolved through this mechanism may be brought to the competent courts within the Republic of Indonesia.
