Terms of Service

Fibidy is a digital marketplace platform that facilitates transactions of digital products in PDF format between sellers (Sellers) and buyers (Buyers). Fibidy is operated independently by an individual operator based in Indonesia.

Fibidy provides the technical infrastructure — accounts, online stores, file storage, payment processing via Stripe, and the Discover feature for product discovery. Fibidy is not a party to the sale transaction between Seller and Buyer. The sales contract is formed directly between Seller and Buyer.

At this time Fibidy only supports digital products in PDF format. Other formats are not available.

"Platform" means the fibidy.com website along with all subdomains and services provided by Fibidy.

"User" means any person who holds an account on the Platform, including Buyers and Sellers.

"Buyer" means a User who purchases digital products through the Platform.

"Seller" means a User who has completed identity verification (KYC) and sells digital products through the Platform.

"Digital Product" means a PDF file uploaded by the Seller for sale to Buyers.

"Transaction" means the purchase of a Digital Product by a Buyer from a Seller through the Platform.

"Stripe" means Stripe, Inc. and its affiliates, the payment processing service used by the Platform.

By registering and using the Platform, you confirm that you have read, understood, and agreed to these Terms of Service along with all related policies, including the Privacy Policy, Refund Policy, and Acceptable Use Policy.

You confirm that you are at least 17 years old or have legal capacity under the laws of the Republic of Indonesia. If you represent an entity, you confirm that you have authority to bind that entity to these Terms.

Fibidy may update these Terms of Service from time to time. Material changes will be notified via email at least 7 days before the effective date. Continued use of the Platform after the effective date is considered acceptance of the latest version.

Standard account registration results in the Buyer role by default. Users who want to become Sellers must upgrade and complete the KYC process via Stripe Connect.

You are fully responsible for the security of your account, including the confidentiality of your password and all activity under your account.

A single individual or entity may only hold one active account. Creating multiple accounts to circumvent restrictions is a violation and may result in account suspension without refund.

You must provide accurate and current information at registration, and update it when things change. False or misleading information may result in account suspension.

Contact admin@fibidy.com immediately if you become aware of any unauthorized access to your account. Fibidy is not liable for losses resulting from your failure to safeguard your credentials.

Fibidy acts as a technical facilitator and is not a party to the transaction between Buyer and Seller. All sales contracts for Digital Products are formed and apply directly between Seller and Buyer.

Fibidy does not own, produce, hold inventory of, or warrant the quality, accuracy, merchantability, or fitness for a particular purpose of the Digital Products sold on the Platform.

Sellers are fully responsible for the Digital Products they sell, including their content, legality, intellectual property, descriptions, pricing, and fulfillment of obligations to Buyers.

In the event of a dispute between Buyer and Seller, Fibidy may help facilitate communication and provide technical evidence from the system, but is not a party to the dispute and is not responsible for its resolution.

Payments on the Platform are processed by Stripe. Fibidy does not store, receive, or directly process payment card data. All payment processing is subject to Stripe's terms of service.

The Platform uses the Direct Charges model through Stripe Connect. Buyer payments go directly to the Seller's Stripe Connect account. Fibidy deducts an application fee as the platform fee at the time of transaction.

The platform fee structure varies based on the Seller's subscription tier and the source of the transaction. Full details are available in the Fee Structure at fibidy.com/legal/fees.

Stripe charges a separate payment processing fee that is deducted directly from the Seller by Stripe, in addition to Fibidy's platform fee. This amount is set and may be changed by Stripe.

All transactions on the Platform are settled in USD. International Buyers may see prices in their local currency via Stripe's Adaptive Pricing, but final settlement remains in USD.

Fibidy may change the platform fee structure with at least 30 days' prior notice to active Sellers via email. Changes are not retroactive — completed transactions keep the fee that was in effect at the time of transaction.

The Platform provides an automatic refund mechanism to protect Buyers from inaccessible or corrupt files. Buyers may request a refund within 7 days of the purchase date.

Refunds are approved automatically if the system detects that the file cannot be downloaded or is corrupt (cannot be opened as a valid PDF). If approved, funds are returned via Stripe and the Buyer's download access is revoked.

Refunds are automatically rejected if the file is verifiably valid and accessible, if the request is outside the 7-day window, or if a refund for that transaction has already been requested.

Buyers may still file a chargeback through their card issuer in accordance with applicable consumer rights. Chargeback disputes are handled by Stripe under their policies. Sellers who receive 2 or more chargebacks may be subject to automatic account suspension.

The Platform offers subscription tiers for Sellers with different features and platform fees. Currently available: Free, Starter, and Business.

Paid subscriptions are processed by Stripe Billing on a monthly cycle. Payments are non-refundable for the current period — cancellation takes effect at the end of the current period with no pro-rated refund.

Upgrading to the Business tier requires a minimum sales track record as applicable — USD $200 in total sales or at least 20 transactions on the Starter tier.

Fibidy reserves the right to change subscription tier features, pricing, or terms with at least 30 days' notice via email.

To become an active Seller and receive payments, Users must complete identity verification (Know Your Customer / KYC) via Stripe Connect.

The KYC process is performed directly by Stripe. Fibidy does not store identity data collected during KYC — that data is managed entirely by Stripe under their privacy policy.

Sellers must provide accurate and complete information to Stripe. False, misleading, or incomplete information may result in KYC rejection, account suspension, or freezing of payout funds.

Sellers may not upload Digital Products or receive payouts before their KYC status reaches "Active" or "Charges Only". Full KYC details are in the KYC Policy at fibidy.com/legal/kyc.

Sellers retain all intellectual property rights to the Digital Products they upload. Fibidy does not claim ownership of Seller content.

By uploading a Digital Product, the Seller grants Fibidy a limited, non-exclusive, royalty-free, terminable license to store, display, process, and distribute that Digital Product solely for the purpose of operating the Platform. This license terminates when the Seller removes the content or closes their account.

Buyers who purchase a Digital Product receive a personal non-exclusive license to use the purchased file for reasonable purposes. Unless otherwise stated by the Seller, Buyers may not resell, redistribute, or publish the Digital Product commercially.

Sellers warrant that the Digital Products they upload do not infringe the intellectual property, privacy, or other rights of any third party. Infringement of third-party rights is the Seller's sole responsibility.

Copyright infringement reports may be filed through the procedure in the Copyright Policy at fibidy.com/legal/copyright.

Users may not upload, sell, or distribute content that violates the laws of the Republic of Indonesia, including but not limited to pornographic content, content that endangers children, content that promotes violence or terrorism, and content that violates the Electronic Information and Transactions Law (UU ITE).

Pirated products, unauthorized copies of others' work, or content that infringes third-party intellectual property are prohibited.

Files containing malware, viruses, or other malicious code are prohibited.

Using the Platform for fraud, money laundering, tax evasion, or other illegal activities is prohibited.

Fibidy reserves the right to remove violating content, suspend or terminate violating accounts, and report violations to the relevant authorities in accordance with applicable law.

The Platform is provided "as is" without express or implied warranties of fitness for a particular purpose, reliability, uninterrupted availability, or freedom from errors.

Fibidy is not liable for transactions, product quality, or disputes between Buyers and Sellers. Fibidy also does not guarantee any level of sales, search engine ranking, or any commercial result.

To the extent permitted by law, Fibidy's total financial liability to a User for all claims arising from or related to the Platform will not exceed the amount the User has paid to Fibidy in the 3 months preceding the claim. For Users on the Free tier, the liability cap is zero.

Fibidy is not liable for indirect, consequential, or incidental damages, lost profits, lost data, or lost goodwill arising from the use of or inability to use the Platform.

These limitations of liability apply fully except where limited by applicable law that cannot be waived.

Users agree to release and indemnify Fibidy against any claims, losses, or costs (including reasonable legal fees) arising from a violation of these Terms of Service, violation of applicable law, or infringement of third-party rights by the User.

This provision applies specifically to Sellers for Digital Products they upload and sell through the Platform.

Fibidy reserves the right to suspend or terminate a User's account, temporarily or permanently, without prior notice, if the User violates these Terms of Service, violates applicable law, or takes action that endangers the security or integrity of the Platform, other Users, or third parties.

Sellers who receive 2 or more chargebacks are subject to automatic suspension. Status may be reviewed after manual review by the Fibidy team.

Users may close their accounts at any time by contacting admin@fibidy.com. Closure is permanent — data is deleted within 30 days in accordance with the Privacy Policy. Active paid subscriptions continue until the end of the period with no pro-rated refund.

If Fibidy permanently ceases operating the Platform, notice will be given at least 30 days in advance to all active Users via email. Sellers will have the opportunity to download their data and receive payout of settled funds in accordance with Stripe's terms.

These Terms of Service are governed by and interpreted under the laws of the Republic of Indonesia.

Any dispute arising from or related to these Terms of Service will first be resolved through good-faith consultation via email to admin@fibidy.com within 30 days of the notice of dispute.

If consultation does not reach agreement, disputes will be resolved through the competent courts within the Republic of Indonesia in accordance with applicable law.

If any provision of these Terms of Service is held invalid or unenforceable by a competent court, the remaining provisions remain in full effect.

Fibidy's failure to enforce any provision of these Terms of Service is not a waiver of its right to enforce that provision in the future.

These Terms of Service constitute the entire agreement between Fibidy and the User regarding use of the Platform, and supersede all prior agreements or arrangements.
